The talk will cover when judicial review (JR) can or should be used in criminal cases, and cover the basics of how to bring a JR with a criminal legal aid contract.
The panel will also discuss the types of decisions that can be challenged, with a focus on victims of trafficking. This discussion will cover the decisions by the Crown Prosecution Service (CPS) as to whether to prosecute (versus abuse of process), the duties local authorities owe to victims of trafficking, and when and how these should be challenged.
Topics will include:
- An overview of how you can use JR as a criminal solicitor, the types of decisions you could challenge, and why you might want to
- How to bring a JR claim as a criminal solicitor
- Trafficking Victims - Decisions to Prosecute and Local Authority Duties
- Safeguarding and support for child victims of trafficking: Challenging local authorities/NRM decisions/age determinations
