Adrian Berry, Garden Court Chambers (Chair)
Adrian’s practice spans a range of inter-related public law areas concerning citizenship, immigration, human rights, international protection, and social assistance. Adrian acts for a small number of clients with complex and sensitive asylum and international protection claims. He provides advice and representation in matters arising under the 1951 Refugee Convention, the Refugee Qualification Directive (2004/83/EC) and the European Convention on Human Rights. He writes a blog on migration, citizenship, and free movement called Cosmopolis and also has a blog on Nationality and Citizenship law.
In community care matters, he acts and advises clients, and migrants, in particular, on access to community care services, and on lawful decision-making in the assessment and provision of care to people in need of services.
Bethan Harris, Garden Court Chambers
Bethan practises in Community Care Law, Social Housing and Court of Protection health and welfare. She is an editor of the Community Care Law Reports and writes regularly for Legal Action Magazine. She is consistently recommended in the legal directories in her three areas of practice. She was shortlisted for a 2023 Legal 500 Barrister of the Year award in Community Care and Court of Protection. She is currently representing Welsh bereaved families in the Covid-19 Inquiry. Bethan is a member of a working group working to improve access to legal aid in Community Care Law. She has been a member of Garden Court Chambers since 1997.
Desmond Rutledge, Garden Court Chambers
Desmond's main area of practice is welfare benefits (where exceptional funding is available) and judicial review if this is the appropriate remedy. He is also a member of the Housing Team. His published work includes the Housing Benefit Update (Legal Action Magazine) and the Housing Law Handbook (Law Society 2021). His reported cases include; Harrington v Secretary of State for Work and Pensions [2023] EWCA Civ 433 (a disabled child’s derived right to benefit under Regulation (EC) 883/2004; and Commissioners for His Majesty's Revenue and Customs v Arrbab [2024] EWCA Civ 16 (Whether statutory instrument ultra vires insofar as making HMRC the effective gatekeeper of appeal to the First-tier Tribunal).
Raza Halim, Garden Court Chambers
Raza specialises in public law, with an emphasis on refugee law and human rights. He specialises in judicial review and appellate work in the fields of international protection, civil liberties and national security, regularly acting in test case litigation challenging Executive policy, at first instance through to the Supreme Court. He is ranked in Chambers & Partners and Legal 500.
