On 17th September 2020, the Law Commission published their consultation paper on Part 2, Proceeds of Crime Act 2002 which governs the post-conviction confiscation regime. The wide-ranging proposals therein aim to address the most pressing problems with the law on confiscation, including the frequent imposition of unrealistic orders, the complexity of the legislation and the ineffective mechanisms for enforcement.
During this virtual webinar, members of the Commission and a panel of Garden Court’s leading fraud and confiscation practitioners will summarise and address some of the key proposals contained within the paper, particularly concerning the objectives of the regime and the definition and valuation of benefit. There will then be an opportunity for participants to respond to these issues, address any other sections of the consultation paper and raise additional concerns and problems with the current confiscation regime.
