Ian Peddie QC is a senior silk with specific experience in both care cases and criminal cases involving family and children issues, Jo Delahunty QC is a specialist child abuse family practitioner, and Judy Khan is a senior criminal junior recently appointed to sit as a Recorder. This seminar seeks to explore issues that arise when children are both the subject of public law care proceedings and alleged victims in a parallel criminal trial. It will discuss issues such as whether the two sets of proceedings are in conflict or can be usefully linked , how to manage cross disclosure issues, whether a 'Chinese wall' can operate between criminal defence and parent family solicitors and what the child’s rights are : are they are adequately respected and protected. Contributions from the floor are invited in this complex and dynamic area of law and practice.
