This seminar will provide delegates with an outline of the issues which arise in trials involving the profoundly deaf. Delegates will leave with an increased understanding of the complexities that can occur when cases involve witnesses or defendants who rely predominantly on sign language.
This seminar will cover:
- The culture clash between the hearing and the deaf and how this can factor into the trial process
- Specific issues which can arise in relation to fitness to plead and competence
- The dichotomy between the visual and the verbal and its effect on the adduction of evidence
- The adaptation of special measures
- An analysis of the current case law

About the speakers
Clare Wade is a member of the Garden Court Chambers Crime Team. She is an experienced criminal defence barrister and has particular expertise in representing vulnerable defendants.
Dr Sue O'Rourke is a chartered clinical psychologist, a sign language interpreter and the lead author of the Advocacy Training Council Toolkit, Planning to question someone who is deaf (forthcoming).
