The aim of this seminar is to provide an update on the latest legal developments relating to possession proceedings, providing practitioners with practical tips, guidance and tactics in a number of areas that may arise when defending possession cases. It is aimed at practitioners of all levels working in this area of social housing law.
This seminar will cover possession actions where water rates are claimed; mandatory grounds for possession are relied on; and counterclaims are brought. Social housing specialists from Garden Court will also provide practical tips and guidance relating to Article 8 ECHR, public law and Equality Act 2010 defences in possession cases.
Speakers
James Bowen (1979) is a social housing specialist. Described in the Chambers UK Bar Guide as "hugely experienced and extremely knowledgeable", his main areas of practice are possession, all aspects of anti-social behaviour, disrepair, unlawful eviction and homelessness.
Marina Sergides (2000) specialises in all areas of social housing law. She has extensive experience in nuisance possession proceedings, s2014 homelessness appeals, unlawful eviction and harassment claims with a focus on human rights and public law defences. In particular, Marina has worked extensively in cases involving tenants with mental health problems where capacity has been in issue, and where the Official Solicitor has been instructed.
John Beckley (Chair) (2003) is widely endorsed for his effective representation of vulnerable and distressed clients and he is ranked for social housing in both the Chambers UK Bar Guide and Legal 500. His housing practice takes in homelessness, community care, anti-social behaviour possession claims and disrepair cases. John also sits as a Deputy District Judge.
