The aim of this seminar is to assist practitioners in understanding tactical considerations involved in injunctions. Speakers will provide updates and practical guidance for practitioners working on anti-social behaviour injunctions (ASBs), unlawful eviction and disrepair cases.
The focus of the seminar will be on obtaining and resisting injunctions, with tips based on first instance decisions and will consider practical scenarios such as:
- What evidence does a tenant need to obtain an ex parte injunction against a neighbour?
- Can you bring disrepair proceedings using legal aid where the landlord agrees to do some works?
- Can a landlord seek an interim ASB injunction against a tenant accused of just noise nuisance?
- How to defend committal proceedings under the new legal aid regime
This seminar will cover:
- The mechanics of applying for an injunction, including CPR 25 interim and ex parte injunctions
- Anti-social behaviour injunctions
- Unlawful evictions
- Disrepair cases
