Increasing numbers of tenants in the social housing sector have limited security of tenure. Others can face possession proceedings on mandatory grounds, including ground 8 and the 'absolute' ground for possession based on serious anti-social behaviour.
This seminar will give a practical guide to defences and counterclaims based on the Equality Act, covering both the latest developments in case law and practice points.
The seminar will cover claims for possession (i.e. claims based on rent arrears, or on ASB or on other mandatory grounds), the declining assistance of article 8 as a means to defend possession, and the importance of the Equality Act, both prior to the making of possession and at enforcement stage. It will cover disability defences and the use of other protected characteristics. It will also address the availability and the tactical use of Equality Act counterclaims.
