Taking an interdisciplinary approach to support for destitute migrants, members of the Garden Court Chambers Community Care Team delivered practical advice on how to assist lay clients struggling to secure accommodation. Amanda Weston KC will chair the event.
Maaha Elahi provided an update on recent case law relating to Section 95 accommodation and support. In particular, she examined how practitioners can best present challenges to Section 95 accommodation decisions in light of the recent case of DXK, R (On the Application Of) v Secretary of State for the Home Department (Rev1) [2024] EWHC 579 (Admin) (15 March 2024) (bailii.org), highlighting the importance of public bodies monitoring their public sector equality duty.
Nadia O'Mara, who regularly appears in claims engaging both asylum support and support under the Care Act 2014, outlined the overlaps between Care Act support and support provided by the Home Office, advising practitioners on how to navigate the intersection between the two.
Finally, Georgie Rea, focused on support for minors under the Children Act. She referenced the new powers under the Illegal Migration Act 2023 and the recent litigation, in which Garden Court Chambers were instructed, where the High Court ruled that the Home Office action in relation to unaccompanied asylum-seeking children was unlawful, when it chose to place them in hotels rather than into local authority care, across the country, through the statutory National Transfer Scheme.
