When does prevention become gate-keeping?
Practices which have ended up in the Courts include:
- Requiring applications for homelessness assistance first to go through "home options" schemes
- Using mediation as a substitute for making inquiries into an application for homelessness assistance
- Applying the wrong criteria when deciding whether or not to secure interim accommodation
Jan Luba QC and Liz Davies are the co-authors of Housing Allocation and Homelessness (Jordans). The second edition has just been published and includes a new chapter on the lawful use of prevention policy. The speakers will review recent decisions by the Courts and Ombudsmen and provide some guidance on when prevention can lawfully be used in conjunction with an application for homelessness assistance.
