The Law Commission’s final report and draft Bill were published on 13 March 2017, recommending the repeal of the Deprivation of Liberty Safeguards (DoLS) and the introduction of a new scheme "as a matter of pressing urgency”.
Please join us for a discussion on:
- What the report and draft Bill say about the scope of the Liberty Protection Safeguards (the new scheme recommended to replace the DoLS)
- How would the new scheme work, considering:
- 16–17 year olds
- people cared for in their own homes
- self-funders
- interface with the Mental Health Act 1983
- changes to the law on inquests
- The significance of the wider recommendations on decision-making, including:
- changes to the law on giving weight to wishes and feelings
- the restriction on the defence in Section 5 Mental Capacity Act 2005
- supported decision-making schemes
- Whether the reforms would provide better protection for Article 5 and Article 8 rights
