This seminar will examine recent and forthcoming statutory developments in relation to possession actions.
This will include the forthcoming changes to the private rented sector contained in the Deregulation Act 2015 in respect of protection for tenants from retaliatory evictions and the revised tenancy deposit scheme. It will also include the new and amended statutory grounds for possession for secure and assured tenancies introduced in October 2014, in particular the new mandatory ground, and its relationship with the new regime for civil injunctions.
This seminar will cover:
- The prohibitions set out in the Deregulation Act 2015 on the use of s.21 notices where issues of disrepair have been raised and/or landlords have failed to comply with prescribed legal/information requirements
- The revised guidance for local authorities on improving the private rented sector and tackling bad practice amongst landlords
- Amendments to the law on tenancy deposits
- Changes to the Housing Act 1985 and Housing Act 1988 introduced in October 2014 by the Anti-Social Behaviour Crime and Policing Act 2014
- Regulations prescribing the review procedure in respect of mandatory grounds for possession for secure tenants
