This seminar aims to assist housing and community care law practitioners in preparing for the fundamental reform that will be brought about by the Care Act 2014. Delegates will leave with an enhanced understanding of the legal framework of the Act, regulations and the duties to provide/arrange for the provision of accommodation under Part 1 of the Act.

This seminar will cover:

  • The new general duty to promote well-being, including in relation to the suitability of living accommodation
  • The replacement of s 21(1) National Assistance Act 1948 by the new duty to meet needs for care and support
  • The legal framework for assessment of needs for care and support, and the eligibility criteria
  • How the Act delineates between accommodation under Housing Act 1996 and accommodation provided to meet a need for care and support
  • How the Act enables people to exercise choice as to the accommodation to be provided
  • Accommodation as an "after-care service" under s.117 Mental Health Act 1983: the new definition of after-care services and rights to exercise choice as to accommodation provided under s 117

Bethan Harris practises in housing, community care and Court of Protection law and has expertise in cases involving community care assessments and issues of mental capacity.

Beatrice Prevatt practises in all areas of housing law, and has expertise in homelessness, Children Act and community care accommodation duties, and accommodation issues for asylum seekers.

Maya Naidoo will be chairing the seminar. Maya has expertise in housing, community care and civil law, and has significant experience of representing vulnerable clients with mental health issues.
