This webinar examined a number of key issues that arise during protest trials in the criminal courts. It began with a detailed look at the case law surrounding the withdrawal of defences and the timing for such applications, with a particular focus on the necessity defence. The webinar also looked at legal strategies for calling your client, the significance and admissibility of expert evidence, the jury’s right to return a verdict according to their conscience, and sentence and mitigation for protesters.

Russell Fraser, Barrister, Garden Court Chambers (Call: 2010)
Russell is a criminal defence specialist with experience defending in a range of cases including serious violence, fraud, and drug supply. He is particularly interested in public order, protest, and terrorism. He has appeared in many protest cases including Extinction Rebellion, the Stansted 15, and Sweets Way.
Susan Wright, Barrister, Garden Court Chambers (Call: 2013)
Susan Wright is a crime and human rights barrister who has acted for protesters at weapons fairs, and hunts as well as individuals from the Stansted 15 and Extinction Rebellion.
Audrey Cherryl Mogan, Barrister, Garden Court Chambers (Call: 2014)
Audrey Cherryl Mogan is a specialist criminal defence barrister with particular expertise representing vulnerable defendants. She has experience in cases involving victims of trafficking, drugs, serious violence and protest law, having acted for Stonehenge, Extinction Rebellion and Heathrow Pause protesters to name a few. Audrey has in-depth knowledge of European and international human rights law gained through ten years in the NGO sector, and is a committee member of the Black Protest Legal Support group and Young Legal Aid Lawyers.
