The Court of Appeal has reduced the custodial part of an extended sentence from 21 years to 18 years in the case of an offender convicted of a series of rapes. The offender had been 18 years of age at the time of his commission of offences.
David Emanuel, who did not appear in the Crown Court proceedings, persuaded the Court of Appeal that the sentencing judge had not given sufficient weight to the offender having only recently attained the age of 18. In an important decision, the Court of Appeal held that the sentencing guidelines for children and young persons had relevance when determining sentence in the cases of young adult offenders.
