After legal submissions from Michael Ivers QC and Martin Huseyin for defendant David Osadebay, known to fans as grime star CBiz, a Judge at the Old Bailey has decided that there was no case to answer.
Central to the decision was the detailed cross-examination of the police witnesses concerning misattributed social media evidence (now increasingly relied upon in cases) and analysis of the phone evidence which revealed inherent weaknesses in the defendant’s phone attribution. Michael and Martin were instructed by Ali Has and Guven Ates of Morgan Has Solicitors. The case has been reported in the press, including by the BBC.
Before Christmas, the Crown was forced to drop the murder charge against two co-defendants in the same case, Mr Trott and Mr Young. Mr Trott was represented by Michael Turner QC and Sam Robinson of Garden Court Chambers. They established that the gunman was 5’4” as opposed to 6” (as Mr Trott is), and that the car he was in, driven by Mr Young, was actually not the car that was in the CCTV footage, as the Crown had asserted. They also established that the cell site analysis was unreliable. Finally, by cross-examining the Crown’s main witness, they got him to admit that he had lied and in fact could provide an alibi to both Mr Trott and Mr Young.
