Dr Tim Baldwin (2001)
Tim joins Garden Court Chambers from 5 Pump Court. In Tim's Housing practice the bulk of his work has concerned the representation of tenants in local authority possession proceedings. These cases all have a strong Public law dimensions either by reference to other public law duties or by reference to inherent failures by local authorities in seeking possession. Most of Tim's Housing cases are rent arrears and disrepair cases but also he also deals with succession cases and cases involving Community Care and Mental health issues. Tim has represented defendants in Mortgage Possession proceedings, Charging Orders and Freezing Orders linked to real property. With Welfare Benefits Tim has provided representation in the Appeals Service in housing and disability benefits. Tim also advises and represents both Claimants and Defendants in personal injury claims. Tim advises and represents a number of local authorities in Homelessness and Housing cases. Advice on Housing and Council Tax benefit issues, mental health and community care matters. He also represents local authorities in criminal proceedings, including benefit fraud, nuisance, environmental protection and regulatory offences.
Tim is a co-author of The Anti-Social Behaviour Act 2003: Special Bulletin and The Housing Act 2004: A practical Guide (both by Jordans). He is also a co-author of Legal and Ethical Aspects of Anaesthesia, Critical Care and Perioperative Medicine (CUP) and a number of articles concerning medical law and ethics.
Edward Fitzpatrick (1990)
Joining us from 1 Mitre Court, Edward is a specialist in Housing Law with particular interest in Homelessness cases and Human Rights issues. Worked on a wide range of Landlord and Tenant cases from boundary disputes to commercial leases. He undertakes a range of common law work having cut his teeth in a mixed set where he gained experience in both criminal and civil work before developing his practice in the areas specified. Very much a court advocate whether in dealing with strong factual disputes in nuisance cases, or complex legal submissions in Judicial Review. Employment work has been principally dealing with cases involving unfair dismissal and racial discrimination. Edward is experienced in contract litigation and professional negligence claims associated with solicitors in landlord and tenant work.
Before coming to the Bar, Edward worked for five years in the voluntary sector including: Housing Advice Worker; Manager Belfast Housing Aid; Welfare Rights Advisor; Housing Officer. Advocate for the Free Representation Unit. Edward is an active member of the Housing Law Practitioners Association recently holding a lecture on Defending Anti-Social Behaviour Cases; Prepared the Associations response to Home Office Consultation Paper 2007 re ASB strengthening powers. He is a contributor to the Housing Case Law section of Legal Action and conducts specialist seminars.
Richard Harvey (1971)
Richard Harvey joins Garden Court's Crime team from Tooks chambers. Richard has a wide ranging and formidable international and domestic reputation in Human Rights, Crime and Tribunals of Inquiry, International Criminal Tribunals, Criminal Appeals and Inquests. In the United States Richard's practice has included Governmental Representation and acting as counsel to Government of South Africa since 1996, advising on inter-governmental relations, contracts and compliance with US legislation standards.
Richard also acted as counsel assisting President Jean Bertrand Aristide in prosecuting human rights crimes in Haiti. In addition Richard was appointed counsel on ad hoc basis advising governments of various Asian, African and Caribbean countries, including Namibia, Cape Verde, Trinidad & Tobago and Vietnam.
Richard's Human Rights Representation includes periods as counsel to ANC of South Africa in US since 1982, advising representatives to United Nations in anti-apartheid issues; counsel to SWAPO of Namibia in US, 1982-1999; advising SWAPO representative to United Nations. In addition Richard acted as counsel to Friends of Sinn F←in of Ireland, advising President of Sinn Fein in relations with United States elected officials
