The High Court has ruled that an Eritrean national, who is a victim of torture, was unlawfully detained by the Home Office. The claimant was represented by Greg Ó Ceallaigh.
The Court found that substantial damages are payable to the claimant for their detention between 8 September and 21 September 2015. The judge also concluded that if procedures had been properly followed, the claimant would have been lawfully detained between 24 August and 8 September. Therefore, only nominal damages are payable during that period.
