In a new landmark Housing case, the House of Lords has decided this week that the nightmare of "tolerated trespasser" status does NOT apply to most tenants of housing associations or to tenants in the private rented sector. While thousands of former council tenants will keep that status until it is abolished by new legislation next year, the Lords judgments also give them considerable help in getting their tenancies back. Jan Luba QC acted as Leading Counsel for Mrs White in her appeal against a previous ruling in favour of her housing association landlords, Knowsley Housing Trust.
