In September 2020, Tessa Buchanan acted for the Claimant in the first contested trial challenging an estate agent’s “No DSS” policy. In an oral judgment given at the end of the trial, the Judge allowed the claim and awarded the Claimant £6,000 in damages plus his costs on an indemnity basis. Full written reasons for that decision have now been handed down. These confirm that by rejecting the Claimant just because he received Housing Benefit, the Defendant subjected the Claimant to unlawful indirect disability discrimination.
