Marc Willers was recently instructed by Community Law Partnership (CLP) to represent the firm in judicial review proceedings brought against the Legal Services Commission (LSC) following the rejection of its bid for a Social Welfare Law contract.
CLP, a Birmingham law practice, were refused a contract because of a failure to fulfil one criterion in the tender process - the tribunals criterion. The Law Society Gazette reported that at the initial hearing before Collins J, the Judge stated "I am bound to say this is a dreadful decision and on the face of it the approach [taken by the LSC] is totally irrational."
The hearing was adjourned and on 6 September the LSC indicated that it was able to offer CLP a contract. As a consequence the judicial review claim was settled.
