Mark secured an acquittal for his client charged with threats to kill and stalking at Inner London Crown Court.
The defendant was alleged to have made threats to kill his ex-partner and stalked her after she threw him out of their home and refused to give him back his belongs. The defendant revealed he had suffered domestic abuse at the hands of the complainant and believed his belonging would be damaged. The defendant accepted that he sent a threatening voice note to his ex-partner, phoned 999 and abused the call handler, but maintained he was frustrated and had no intention of carrying out the threat to kill his ex-partner.
The prosecution served the complainant’s Police National Computer (PNC) check which revealed she had nine separate convictions for assaulting various individuals since 2009, and three separate convictions for criminal damage. Mark took further instructions from the defendant and served an addendum defence case statement and a non-defendant bad character application pursuant to s.100 Criminal Justice Act 2003.
The prosecutor conceded that it would be difficult to prove the threats to kill and stalking allegations, and offered no evidence on the substantial two counts. Acceptable pleas were then offered to the lesser charges of sending an electronic communication with intent to cause distress.
