Michael Ivers QC of the Garden Court Chambers Crime Team represented the defendant leading Kevin Metger of Great James Street Chambers and Zaheer Afzal of St Philips Barristers instructed by Aftab Zahoor of Clayton Solicitors.
Michael Ivers QC secured an acquittal on all three counts of murder, manslaughter and robbery within four hours at Warwick Crown Court following a five week trial.
Mr Ivers QC was instructed shortly before the trial which followed two previous trials that had not reached a conclusion due to illness. His requests for the underlying material from the CCTV evidence and its close analysis revealed important matters which assisted the defence case and had not previously been known about.
The police officer accepted under cross-examination that evidence given before two previous juries was in fact factually incorrect; the case also involved important new evidence adduced by Mr Ivers QC from the pathology. It was acknowledged that the case had changed markedly as a result of this work.
