For many lawyers and advisors working in housing law the mental health of our clients will affect both the problems that arise and the advice that we give. This seminar is aimed at improving the understanding of housing related issues faced by people with mental health problems and developing better ways of working.
District Judge Sue Jackson, of the Court of Protection, will look at the work of the Court and ways to most effectively represent clients before the Court.
Catherine O'Donnell will consider the recent case of Lewisham BC v Malcolm and talk on what, if any, role mental health may have in housing possession cases.
John Beckley will consider the role of mental health in homelessness and injunctions and will consider the question of mental capacity and work with the Official Solicitor.

This seminar will cover the scope for challenging housing association decisions on administrative law and Human Rights Act grounds since R (on the application of Weaver) v London and Quadrant Housing Trust [2008] EWHC 1377 and Doherty v Birmingham CC [2008] UKHL 57 both by way of judicial review (eg allocation of housing) and by defending possession proceedings (including ground 8). Liability for the anti social, racist behaviour of tenant neighbours will also be considered, distinguishing Malazam Hussein v Lancaster CC 2000 QB 1 (CA)
