The Court of Appeal has granted some of the claimants challenging Home Office decisions to remove asylum seekers in the UK to Rwanda- including AS, who is represented by members of Garden Court Chambers - permission to appeal on additional grounds. This judgment has been featured in The Guardian.
The widened scope of the appeal now includes issues such as whether the Government's inadmissibility policy was unlawful.
Previously, the Divisional Court handed down judgment on 19 December 2022, ruling that the Government's plan to send asylum seekers to Rwanda in order for their asylum claims to be processed there rather than here was generally lawful.
The Claimants applied for permission to appeal the judgment on various grounds. The Divisional Court granted permission to appeal on some of the grounds in January 2023. See our previous news item here.
The hearing is expected to take place between 24 to 27 April 2023.
