The Court of Appeal has upheld a decision that poker is a game where chance and luck predominates the player's skill. While the court accepted Mr Kelly's plea for a modern interpretation of gaming law, it decided that present legislation meant it had to find that Poker was a "game of chance" however much skill was actually involved. Playing Poker was therefore "gaming" for the purposes of the criminal law. Mr Kelly is considering whether to appeal to the House of Lords.
