Court of Protection Practice Direction updates: Case Management Pilot; s 49 Reports Pilot; and the extension of the Transparency Pilot
Case Management Pilot to commence on 1 September 2016
The pilot is provided for in the case management pilot Practice Direction. Cases to which the pilot applies, and which are not excepted cases, will be allocated to one of three case management pathways.
The objective is to require applicants to provide improved analysis of the issues at the start of a case, allowing for more robust case management decisions to be taken at the outset and all issues to be identified at the earliest opportunity in proceedings, to seek to encourage early resolution of cases, reduce the number and length of hearings required in contested cases and to promote judicial continuity.
The pilot will operate from 1 September 2016 to 31 August 2017. It will apply to all proceedings started on or after 1 September 2016. Proceedings are started when the court issues an application form at the request of the applicant.
Where the pilot applies the Court of Protection Rules will apply with the modifications set out in the Practice Direction and its annexes.
S. 49 MCA 2005 Reports Pilot to commence on 1 September 2016
The pilot is provided for in Practice Direction 14E (Pilot). It will continue until 31 August 2017.
Transparency Pilot extended to 31 August 2017
The pilot is extended by amendment made on 30 July to the Transparency Pilot Practice Direction.
