Stephen Knafler QC and David Renton represented activists on Wednesday in their application to set aside a possession order granted in favour of Sun Street Property Ltd, a wholly-owned subsidiary of the UBS Bank.
Although at the end of the hearing, the activists' application was refused, Roth J made a series of findings as to the defects in the procedure under which the possession order had been granted. Roth J also granted a 24 hour stay of the writ of possession. Stephen and David have since made an application to the Court of Appeal for permission to appeal Roth J's decision and the Court of Appeal has granted a further stay.
