The Court of Appeal held today (in a majority 2:1 judgment), in Fitzroy George v Secretary of State for the Home Department that whilst the making of a deportation order invalidates a person's leave to remain, any subsequent revocation of the deportation order (for example as a result of a successful appeal against the making of the deportation order, or against a refusal to revoke a deportation order) results in the leave to remain automatically reviving. The Secretary of State could then decide to revoke that leave to remain, but that would be an appealable immigration decision. To read the full judgment click here.
