The legal team secured the release of a client held in immigration detention for over a year, within two days of filing a judicial review claim.
The claimant had been detained under immigration powers for more than 12 months before instructing solicitors. The legal team sent pre-action correspondence and filed an urgent application for Judicial Review in the Administrative Court.
The claimant was released from detention within two days of the claim being filed and the interim relief hearing was vacated. The client subsequently re-instructed solicitors due to a significant delay and the ongoing failure of the Secretary of State for the Home Department (SSHD) to facilitate his voluntary departure from the UK.
The SSHD unlawfully refused to vary his immigration bail conditions or formally approve his requests to leave the UK voluntarily for more than six months. The team issued another application for judicial review. The SSHD subsequently conceded and allowed the claimant to return to his family in Slovakia.
