Lincoln Crown Court has allowed the appeal against conviction of T on the grounds that he was a victim of human trafficking. The appellant was represented by Taimour Lay.
T was a minor when he was prosecuted and convicted of cannabis cultivation. His legal team argued that there was clear evidence he was trafficked in the UK and subjected to forced labour. A successful application to the Criminal Cases Review Commission led to referral to the Crown Court which quashed the conviction at a hearing in 2014, applying L & Ors v The Children's Commissioner for England & Anor [2013] EWCA Crim 991.
Taimour was instructed by Philippa Southwell of Birds Solicitors.
Taimour Lay is a member of the Immigration Team at Garden Court Chambers and specialises in trafficking and human rights.
